Welcome to CHAUD.

These Terms of Service ("Terms") govern your access to and use of the CHAUD website, and your purchase and use of products and services offered by CHAUD STUDIOS ("CHAUD", "we", "us", or "our").

By accessing our website, placing an order, or otherwise using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or place an order with CHAUD.

CHAUD currently operates as an online business and sells and delivers products within Malaysia.

2. Eligibility

By using our Services or placing an order with CHAUD, you confirm that:

  • you are at least 18 years old; or
  • you are using our Services with the knowledge and supervision of a parent or legal guardian.

You also confirm that all information provided to CHAUD is accurate, complete, and current.

You are responsible for ensuring that your use of our Services complies with all applicable laws and regulations.

3. Products

CHAUD creates digitally manufactured and made-to-order products.

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, colours, and other information displayed on our website accurately represent our products.

However, due to the nature of digital manufacturing and the materials and processes used, reasonable variations may occur between individual pieces.

These may include minor differences in:

  • colour or shade;
  • surface texture and finish;
  • layer lines or other characteristics resulting from the manufacturing process;
  • dimensions within reasonable manufacturing tolerances; and
  • appearance resulting from lighting, photography, or individual display settings.

Such variations do not necessarily constitute a defect or failure to conform to the product description.

Product photographs are provided for illustrative purposes. Actual products may appear slightly different depending on lighting, environment, screen settings, and the manufacturing process.

CHAUD reserves the right to modify, update, replace, suspend, or discontinue any product, material, colour, specification, or design at any time.

4. Orders

When you place an order with CHAUD, you acknowledge and agree that:

  • all information provided during checkout is accurate and complete;
  • you are authorised to use the payment method provided;
  • you have reviewed the relevant product information before placing your order;
  • your order constitutes an offer to purchase the selected product(s); and
  • all orders are subject to acceptance by CHAUD.

After an order is placed, CHAUD may provide an order acknowledgement or confirmation.

An order acknowledgement confirms that CHAUD has received your order. It does not necessarily constitute final acceptance of the order.

CHAUD reserves the right to refuse, limit, or cancel an order where reasonably necessary, including in circumstances involving:

  • suspected fraud or unauthorised activity;
  • inaccurate or incomplete customer information;
  • significant pricing or listing errors;
  • product availability issues;
  • technical or system errors; or
  • violations of these Terms or applicable law.

If CHAUD cancels an order after payment has been received, any amount paid for the cancelled order will be refunded where applicable.

5. Made-to-Order Production

CHAUD products are generally manufactured specifically after an order has been placed.

Once payment has been successfully received and verified, the order will immediately enter CHAUD's production queue.

Because production is initiated specifically for each order, customers acknowledge that an order may no longer be eligible for cancellation once payment has been completed.

Entering the production queue does not necessarily mean that physical manufacturing begins immediately. Production is scheduled according to CHAUD's production workflow, capacity, material availability, and other operational requirements.

Production and fulfilment times may therefore vary between orders.

Any production timeframe displayed on our website is an estimate provided for guidance and is not a guaranteed completion date unless expressly stated otherwise.

CHAUD will make reasonable efforts to process and fulfil orders within the stated estimated timeframe. However, delays may occur due to production requirements, material availability, unusually high order volumes, equipment or technical issues, public holidays, courier delays, or circumstances beyond our reasonable control.

By placing an order, you acknowledge and accept the made-to-order nature of CHAUD products and the production process described above.

6. Pricing and Payment

All prices displayed on our website are in Malaysian Ringgit (MYR), unless otherwise stated.

The applicable product price and any applicable shipping charges or other charges will be displayed before you complete your purchase.

Payment must be successfully received and verified before an order enters the production queue.

You are responsible for providing accurate payment and billing information and for ensuring that the payment method used is authorised for the transaction.

CHAUD reserves the right to correct pricing, product description, promotional, or listing errors at any time.

If a pricing or listing error affects an order that has already been placed, CHAUD may contact you to offer the option to proceed at the correct price or cancel the affected order.

If the order is cancelled as a result of such an error after payment has been received, any amount paid for the affected order will be refunded where applicable.

7. Shipping and Delivery

CHAUD currently ships within Malaysia only.

Shipping charges and estimated delivery timeframes will be displayed or made available to you before you complete your purchase.

Estimated delivery times are provided for guidance and are not guaranteed unless expressly stated otherwise.

Delivery times may be affected by:

  • production schedules;
  • courier delays;
  • incorrect or incomplete delivery information;
  • weather conditions;
  • public holidays;
  • peak periods; or
  • circumstances beyond our reasonable control.

Customers are responsible for providing an accurate and complete delivery address and contact information.

If an order cannot be delivered due to incorrect or incomplete information provided by the customer, additional delivery charges may apply where applicable.

Once an order has been handed over to the selected shipping carrier, the carrier is responsible for the physical transportation and delivery of the parcel. However, this does not limit any rights or remedies available to customers under applicable Malaysian law.

Customers should inspect their order upon delivery and contact CHAUD as soon as reasonably possible if the product arrives damaged, defective, or incorrect.

8. Cancellations, Returns, Replacements and Refunds

Because CHAUD products are made to order and orders enter our production queue immediately after successful payment, orders generally cannot be cancelled once payment has been completed.

Returns, replacements, and refunds are handled in accordance with our Refund & Returns Policy.

Unless otherwise provided by applicable law or our Refund & Returns Policy, change-of-mind returns may be requested within 7 days of delivery, subject to the applicable eligibility conditions.

Returned products must meet the conditions specified in our Refund & Returns Policy, including requirements relating to product condition, use, installation, modification, original packaging, and components.

If a product arrives damaged, defective, or incorrect, customers should contact CHAUD as soon as reasonably possible, preferably within 48 hours of delivery, with appropriate photographs or video evidence.

The available resolution may include a replacement, repair, or refund depending on the nature of the issue and the circumstances of the case.

Nothing in these Terms or our Refund & Returns Policy is intended to exclude, restrict, or modify any consumer right, guarantee, remedy, or protection that cannot lawfully be excluded or restricted under applicable Malaysian law.

Customers should review our Refund & Returns Policy before placing an order.

9. Product Use and Safety

CHAUD products must be used only for their intended purpose and in accordance with any instructions, warnings, specifications, or information provided with the product.

Where applicable, customers are responsible for using compatible electrical components, bulbs, power supplies, and accessories as specified by CHAUD.

Customers must not:

  • modify or alter a CHAUD product;
  • disassemble electrical components without appropriate knowledge or authorisation;
  • use incompatible electrical components;
  • use a product for a purpose for which it was not designed; or
  • intentionally use or operate a product in a manner that may compromise its safety or intended function.

CHAUD is not responsible for damage, loss, or injury resulting from improper installation, unauthorised modification, misuse, negligence, incompatible components, or use outside the intended purpose of the product, except to the extent that such liability cannot lawfully be excluded.

10. Customer Accounts

Where account functionality is available, you are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

You agree to notify CHAUD promptly if you become aware of unauthorised access to or use of your account.

CHAUD reserves the right to suspend or terminate accounts where we reasonably believe that an account has been used in violation of these Terms, applicable law, or for fraudulent or abusive activity.

11. Reviews and User Content

Customers may have the ability to submit reviews, comments, photographs, videos, or other content through our website or other CHAUD channels ("User Content").

By submitting User Content to CHAUD, you grant CHAUD a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, adapt, and distribute that User Content for legitimate business, promotional, marketing, and operational purposes.

You retain ownership of your User Content.

By submitting User Content, you confirm that:

  • you own or have the necessary rights and permissions to submit the content;
  • the content does not infringe the intellectual property, privacy, or other rights of another person;
  • the content is not false, fraudulent, or materially misleading; and
  • the content does not contain unlawful, abusive, defamatory, threatening, or malicious material.

You must not submit content containing malware, harmful code, spam, or unauthorised advertising.

CHAUD reserves the right to remove, refuse, restrict, or moderate User Content where reasonably necessary or where it violates these Terms or applicable law.

12. Intellectual Property

All content appearing on the CHAUD website, including but not limited to:

  • product designs;
  • product names;
  • photographs;
  • videos;
  • graphics;
  • illustrations;
  • logos;
  • text;
  • branding;
  • website design; and
  • other materials

is owned by or licensed to CHAUD and is protected by applicable intellectual property laws.

Except where expressly permitted by CHAUD or applicable law, you may not copy, reproduce, distribute, modify, publish, sell, commercially exploit, or create derivative works from CHAUD's content, designs, branding, or other intellectual property without our prior written permission.

Purchasing a CHAUD product does not transfer ownership of CHAUD's intellectual property, product designs, models, files, or other proprietary materials to the customer.

13. Prohibited Uses

You agree not to use the Services to:

  • violate any applicable law or regulation;
  • engage in fraudulent, abusive, or deceptive activity;
  • interfere with the operation, security, or integrity of our website;
  • attempt to gain unauthorised access to our systems, accounts, or infrastructure;
  • upload or transmit malware, malicious code, or harmful software;
  • use automated tools to scrape, copy, harvest, or collect website content or data without our permission;
  • reproduce, copy, reverse engineer, or commercially exploit CHAUD's proprietary designs or digital files without permission;
  • impersonate CHAUD or another person or entity; or

We make reasonable efforts to maintain accurate, reliable, and up-to-date information on our website.

However, the website and its content are provided on an "as available" basis and may occasionally be unavailable, interrupted, delayed, or affected by technical issues.

To the fullest extent permitted by applicable law, CHAUD does not guarantee that:

  • the website will always be available;
  • the website will operate without interruption;
  • the website will be error-free;
  • all website content will always be complete, accurate, or current; or
  • the website will be free from technical defects or security vulnerabilities.

CHAUD reserves the right to modify, suspend, or temporarily restrict access to the website or any part of the Services where reasonably necessary for maintenance, security, operational, or business purposes.

Nothing in these Terms excludes, restricts, or modifies any right, guarantee, remedy, or protection that cannot lawfully be excluded under applicable Malaysian law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, CHAUD will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to:

  • your use of the website;
  • your inability to access or use the website;
  • delays or interruptions caused by circumstances beyond our reasonable control; or
  • misuse of a product contrary to its intended purpose or provided instructions.

Where liability cannot lawfully be excluded or limited, CHAUD's liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits or excludes liability where doing so would be unlawful or where such liability cannot legally be limited.

Your use of the CHAUD website is also governed by our Privacy Policy.

Our Privacy Policy explains how CHAUD collects, uses, stores, discloses, and protects personal information in connection with our business and Services.

By using our website or placing an order, you acknowledge that you have had the opportunity to review our Privacy Policy.

Our website may contain links to or rely on services provided by third parties, including payment providers, shipping carriers, social media platforms, analytics providers, or other external services.

Third-party services may be subject to their own terms, conditions, and privacy policies.

For orders already placed before a material change to these Terms, the Terms applicable at the time the order was placed will generally continue to apply to that order, unless otherwise required by law.

These Terms are governed by and interpreted in accordance with the laws of Malaysia.

Any dispute arising from or relating to these Terms, the website, or an order placed with CHAUD shall be subject to the applicable jurisdiction of the courts of Malaysia.

Nothing in this section prevents a consumer from exercising any statutory right, remedy, or dispute-resolution mechanism available under applicable Malaysian law.

20. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

If it cannot be made enforceable, the affected provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

These Terms, together with the applicable Privacy Policy, Refund & Returns Policy, Shipping Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and CHAUD regarding your use of the Services and purchase of products from CHAUD.

If there is a conflict between these Terms and another CHAUD policy, the relevant policy will apply to the specific subject matter covered by that policy, unless otherwise required by applicable law.
